Information on the processing and protection of personal data

I. Legal framework for processing

The personal data of customers and other persons (hereinafter also referred to as "data subjects") whose personal data Kupfollowers.cz processes are processed in accordance with applicable law.   • The name, surname (including any addition to further characterize the person or business establishment of the natural person), title (if provided by the customer), residential or registered office address, delivery address, VAT number, VAT number, e-mail address of the data subject, telephone number and data on the purchase made are processed for the purpose of contract performance (e.g. The legal basis for the processing of these data for the above purpose is their necessity for the performance of the contract to which the data subject is a party or for the implementation of measures taken before the conclusion of the contract at the request of the data subject.The above personal data are further processed after the performance of the contract if this is necessary for the fulfilment of a legal obligation to which Kupfollowers.cz is subject.

The legal basis for the processing of these data is the legitimate interest of the controller in this case.

The provision of the personal data referred to in Article IV(A) and (F) is a contractual requirement of Kupfollowers.The name, surname, residential address and e-mail address of the Buyer who is a non-business natural person and the name, surname (including any addition characterizing the person or business establishment of the business natural person), registered office address, VAT number, VAT number (for VAT payers) and e-mail address of the Buyer who is a business natural person are also data that must be included in the contract; failure to provide these data may lead to the impossibility of concluding the contract.

VI. Storage period

Personal data will be stored at Kupfollowers.cz for the period required by applicable law, if no such period is specified, for as long as the legal reason for processing lasts or for the period necessary to establish the exercise or defence of legal claims.

VII. Categories of recipients of personal data:

Kupfollowers.cz may delegate the processing of personal data to a third party processor.

  • Providers of accounting, tax and legal services
    The controller is also entitled to provide personal data to persons providing accounting, tax and legal services to the controller for the purpose of fulfilling its legal obligations and in cases where it is necessary for the establishment, exercise or protection of legal claims, whether in judicial, extrajudicial or administrative proceedings.
  • Entities assessing the legitimacy of complaints
    The administrator is entitled to provide the entity providing the administrator with the assessment of the legitimacy of the complaint with tax documents for the purchased goods containing, in addition to the legally required details, the e-mail address and telephone number of the customer.
  • Entities providing direct marketing services
    The controller is entitled to provide an e-mail address and telephone number for the purpose of sending commercial communications to entities that perform this activity for the controller as processors.
  • Entities contacting customers for the purpose of obtaining an evaluation
    The controller is entitled to provide order information and e-mail address to entities contacting customers for the purpose of obtaining an evaluation of the purchased goods and services provided with the consent of the data subject.

VIII. Right of access to personal data

The data subject shall have the right to obtain confirmation from the controller as to whether or not personal data concerning him or her are being processed and, if so, to obtain access to such personal data.

IX. Right to rectification of personal data

The data subject shall have the right to have inaccurate personal data concerning him or her rectified by the controller without undue delay. Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by providing an additional declaration.

X. Right to erasure of personal data

The data subject shall have the right to have the controller erase the personal data concerning the data subject without undue delay and the controller shall be obliged to erase the personal data without undue delay if one of the grounds set out in the General Data Protection Regulation applies.

XI. Right to restriction of processing of personal data

The data subject has the right to have the controller restrict the processing of his or her personal data in the cases provided for in the General Data Protection Regulation.

XII. Right to portability of personal data

Subject to the conditions laid down in the General Data Protection Regulation, the data subject shall have the right to obtain personal data concerning him or her which he or she has provided to a controller in a structured, commonly used and machine-readable format and to transmit those data to another controller without the controller to whom the personal data have been provided,

XIII. Right to object to the processing of personal data

The data subject shall have the right to object at any time, on grounds relating to his or her particular situation, to processing of his or her personal data processed for reasons of legitimate interest by the controller, including profiling based on the controller's legitimate interest. Where personal data are processed for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing, which shall include profiling insofar as it relates to such direct marketing.

XIV. Right to withdraw consent to the processing of personal data

The data subject has the right to withdraw the consent to the processing of personal data at any time. Withdrawal of consent shall not affect the lawfulness of processing based on consent given prior to its withdrawal. Consent may be withdrawn by e-mail sent to the following e-mail address: kupfollowers@email.cz or by written notice sent to the address of the controller's registered office. Consent to receive information about news, discounts and marketing promotions relating to the controller's goods and services can also be withdrawn via the electronic unsubscribe system by clicking on the unsubscribe link directly in the sent e-mail commercial communication.

XVII. Right to lodge a complaint

The data subject has the right to lodge a complaint with a supervisory authority, in particular in the EU Member State of his or her habitual residence, place of employment or place of the alleged infringement, if he or she considers that the processing of his or her personal data infringes the General Data Protection Regulation. In the Czech Republic, the supervisory authority is the Office for Personal Data Protection.
